1. Introduction
Welcome to MyGrooveGuide BV ("MyGrooveGuide," "we," "our," or "us"). These terms of use govern your use of our website, mygrooveguide.com, and access to our online dance classes. By using our website and services, you agree to comply with and be bound by these terms of use. Please read them carefully. If you do not agree with these terms of use, then you must discontinue use of our website and services.
2. Age Restriction and Parental Consent
2.1. The site is intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the site.
2.2. If you are a minor, you must have your parent or guardian read and agree to these terms of use prior to you using the site.
3. User Accounts
3.1. To access our online dance classes, users are required to create an account.
3.2. During the registration process, we collect the following information: name, email address, and country of residence.
3.3. We retain the authority to alter, recover, or modify a username you have chosen if, at our sole discretion, we find that the selected username is unsuitable, offensive, or otherwise objectionable.
4. Payment and Billing
4.1. Payments for our services are processed through Stripe, and you can pay via credit card or PayPal.
4.2. We offer a 7-day free trial for our annual subscription. After the trial period, it automatically converts to a full annual subscription. Users can cancel their subscription for free during the 7-day trial.
5. Content Access
5.1. To view our dance class videos, users should register on mygrooveguide.com. Downloading of the videos is not permitted.
5.2. We offer both monthly and annual subscription options, granting access to all dance classes. The features are the same for both subscription types.
5.3. Users are strictly prohibited from sharing their account credentials or content with others. Users agree to keep their password confidential.
6. Intellectual Property
6.1. MyGrooveGuide BV owns all intellectual property rights to the dance class videos and other content available on our website.
7. User Responsibilities
7.1. Users must adhere to our rules and guidelines for behavior on our website, as outlined in our community guidelines.
7.2. Users are not allowed to engage in any unauthorized utilization of the site, including the collection of usernames and/or email addresses via electronic or alternative methods for the purpose of sending unsolicited emails, or the establishment of user accounts through automated means or false pretenses.
7.3. You may only access or utilize mygrooveguide.com for its intended purpose, as made available by us.
7.4. Users are not allowed to systematically extract data or any content from mygrooveguide.com to create, directly or indirectly, a collection, compilation, database, or directory, unless you obtain written permission from us.
7.5. Users are not allowed to engage in actions that discredit, tarnish, or harm us and/or mygrooveguide.com.
7.6 Users are not allowed to engage in deceitful, fraudulent, or misleading activities towards us or other users, especially with the aim of acquiring sensitive account information, such as user passwords.
7.7 Users are not allowed to use mygrooveguide.com for advertising or offering goods and services.
7.8. Users are not allowed to use any information acquired from mygrooveguide.com to harass, abuse, or inflict harm upon another person.
7.9. Users are not allowed to sell or transfer their profile to someone else.
7.10. Users are not allowed to attempt to circumvent any safeguards intended to prevent or limit access to mygrooveguide.com or its components.
7.11. Users are not allowed to replicate or modify the site's software, including, but not limited to, Flash, PHP, HTML, JavaScript, or any other code.
8. Privacy and Data Collection
8.1. We collect and process user data in accordance with our Privacy Policy. We may use cookies and tracking technologies for various purposes; please refer to our Privacy Policy for details.
9. Feedback
9.1. Users recognize and agree that any questions, comments, suggestions, ideas, feedback, or other information about the site that are provided to us are not confidential and will become our sole property. We will possess full and exclusive rights, including all intellectual property rights, and can freely use and share this feedback for any lawful purpose, whether commercial or otherwise, without the need for recognition or compensation to you.
10. Site Management
10.1. We retain the authority to monitor the site for violations of these terms of use, and we may take legal action against anyone we believe, in our sole discretion, is violating the law or these terms of use. This includes the option to report such users to law enforcement authorities. We also have the discretion, without limitation, to restrict access to or disable certain parts of the site to specific users.
10.2. We may, at our sole discretion and without notice or liability, remove from the site or disable files and content that are excessively large or place an undue burden on our systems. Our goal is to manage the site in a way that safeguards our rights, preserves our property, ensures the site's proper functioning, and, when necessary, restricts access to it.
10.3. We cannot assure constant availability of the site. Occasionally, we may encounter hardware, software, or other issues or need to conduct maintenance on the site, which could lead to interruptions, delays, or errors. We retain the right to alter, update, suspend, terminate, or otherwise amend the site at any time and for any reason, without prior notice to you.
11. Dispute Resolution
11.1. Any disputes between users or between users and MyGrooveGuide will be handled in accordance with Dutch law.
12. Termination and Cancellation
12.1. We reserve the right to terminate a user's account or subscription under certain conditions.
12.2. Users can cancel their subscription at any time before the expiration date. For example, monthly subscriptions must be canceled before the start of the next month.
13. Disclaimer and Liability
13.1. MyGrooveGuide is not responsible for any injuries or accidents that may occur during dance classes. Users participate at their own risk.
14. Governing Law
14.1. Legally we are based in the Netherlands. These terms of use are thus governed by Dutch law.
15. Changes to Terms of Use
15.1. We will update the "Last Updated" date on these terms of use to reflect changes. In the event of changes, we will notify users via email.
